Depression & Anxiety Disability Insurance Claim Help & Tips

We are available nationwide: call 855-319-4421 or email: https://www.diattorney.com/free-consultation/?referrer=yt Disability attorneys Gregory Dell and Stephen Jessup have a very thorough discussion regarding disability claims for depression and anxiety disorders. These claims are the claims which are most highly challenged by the disability insurance companies because the condition is purely subjective and based on self-reported symptoms. There is no way to objectively prove you suffer from depression or anxiety, such as a blood test or x-ray. Disability insurance companies take advantage of this fact and will deny claims for lack of clinical evidence of disability due to the depression and anxiety disorder. Making sure your psychologist or psychiatrist is keeping detailed and legible records of each visit is key. The records must provide documentation of why your depression or anxiety disorder is causing an inability to perform your job. A red flag to look out for if you have are receiving disability benefits for depression or anxiety, is if the disability insurance company sends you for an "Independent" or "Compulsory" Medical Examination with a psychiatrist or if they send you for neuropsychological testing. These exams are used to disprove your claim and look for malingering or overstating/exaggeration of your symptoms. Most disability insurance policies have a limitation for mental/nervous conditions, which include depression and anxiety. A claimant is typically limited to a maximum of 12-24 months of benefits if approved. How to Get Disability Benefits for Depression or Bi-Polar Disorder

05:50
http://www.disabilitydenials.com/bipolar-disorder-disability.html http://www.disabilitydenials.com/depression-disability.html In this video Marc Whitehead, Board Certified Disability Attorney, discusses how someone can receive disability benefits for depression or Bi-Polar Disorder. Similar to physical disabilities not everyone with depression qualifies for disability benefits, yet sever depression can significantly interfere with a persons daily activities and the ability to work. Depression is one of the leading causes of disability world wide. Disability claims based on depression are routinely challenged by insurance companies, Social Security Administration and The Department of Veterans Affairs. If this has been your experience, it may be time to seek legal help in order to prove you are indeed disabled. Depression is not a sign of personal weakness, it is a real mental illness with real causes. The cause may be due to Chemistry, Biology, life experiences, disorders of the brain caused by chemical imbalance, genetics, emotional/physical trauma or a hormone imbalance. Depression can also co exist with a painful medical condition or as a reaction to the condition. There are different forms of depression disorders including major depression, dysthymic disorder, minor depression and bipolar disorder. Symptoms of depression and the severity of each symptom will vary between persons. Depression is an illness that affects the whole person. People who suffer from depression have trouble concentrating, sleeping or eating and have lost interest in taking care of their daily activities. They may also exhibit- avoidance of people, refound grief, and a lack of energy. SSD & Depression: To win SSD for depression you need to prove one thing: That your depression is sever enough to stop you from working. To determine a persons eligibility for benefits the SSA adheres to their Listings of Impairments. The Listing for depression is found under Mental Disorders. If your condition is sever enough to satisfy these requirements, you'll be considered disabled by the SSA. The SSA will need medical evidence to support your exact limitations. This means that they will wanna see medical records and psychiatric records from doctors psychiatrists, physiologists, mental health clinics or other health facilities where you received treatment. VA & Depression: Depression disordered are often endured by Veterans would have lived through the emotional stress of War, the death or injury of fellow soldiers and comrades, living through unbearable conditions or struggling with their own physical injuries or disorders. Veterans Disability benefits are based on the establishment of a service connected impairment. Disability ratings are assigned based on the severity of the impairment or combination of impairments. To arrive at a rating the VA relies on the VA schedule for rating disabilities. Depression is listed under Mental Disorders and further identified as a mood disorder. VA disability payments are then awarded based on this assessment. Depressive disorders may begin because of experiences or injuries the Veteran had while in service. Traumatic brain injury is frequently responsible for the onset of depression. Depressive illness may be closely related to other service connected disorders, such as PTSD. LTD & Depression: You may also be able to clam disability benefits through your LTD insurance for your depression. Whether you have LTD insurance privately or through your employer, it's the insurance carrier who will process the claim. It has become routine practice for many insurance companies to deny legitimate claims for depression or to devalue these claims. Insurance claims for depression disability present their own unique set of challenges- like insurers stating that the disability is not sever enough to qualify for disability. Symptoms of depression are emotional and abstract, sometimes with highs and lows which makes it difficult to measure its severity. This then allows for insurers to claim you do not meet their definition of disability. Most insurance companies have a clause that states mental disorders as mental nervous for which the benefit pay period is limited to only two years. In their attempt to reduce payment periods your insurer may try to award benefits only for depression under the mental nervous condition clause with no separate recognition of the physical disability. Physical and Mental Disabilities: Can Disability Benefits Be Limited?

We are available nationwide: call 855-319-4421 or email: https://www.diattorney.com/free-consultation/?referrer=yt The answer to this question is very fact specific in each case. Not every disability policy has a limited pay period for a mental condition; therefore this issue may not apply to you. Most employer provided long term disability policies will limit mental health disabilities to either 12 or 24 months. In the situation where a claimant has both physical and mental disabilities, then it still may be possible to continue benefits beyond the limited pay period. Our disability benefit lawyers have helped hundreds of claimants to secure benefits beyond the mental nervous limitation period. Is it easy to prove a disability in the workplace? Ask the Expert

01:51
What is the definition of disability? A disabled person is defined as someone with a physical or mental impairment that has a ‘substantial’ and ‘long-term’ effect on their ability to do normal daily activities (Equality Act 2010). What are the benefits of employing disabled people? There are nearly 7 million people of working age in the UK with a disability or have a health condition. Historically there has been a significant gap between the proportion of disabled people employed compared with non-disabled people. Encouraging applications for people with a disability is good for business. It can help you to: • increase the number of high-quality applicants available • create a workforce that reflects the diverse range of customers it serves and the community in which it is based • bring additional skills to the business The costs of making reasonable adjustments to accommodate disabled employees are often low and there are help and support from other organisations. The benefits of retaining an experienced, skilled employee who has acquired an impairment are usually greater than recruiting and training new staff. What are reasonable adjustments? Employers have a legal duty to make reasonable adjustments to support disabled job applicants and employees. This means ensuring disabled people can overcome any substantial disadvantages they may have to do their jobs and progressing in work (Equality Act 2010). Expert employment solicitor Robert Rocker explains and answers some questions about disability discrimination and what is classed as a disability? Transcript of the video My name is Mark Ferron from Castle Associates and I speak to employment law experts across the country and in this short video I am speaking to employment law expert and solicitor Robert Rocker about disability discrimination Is it easy to prove disability discrimination in the workplace? To prove disability discrimination an employee has to show that they have a disability and that that disability impacts on their day-to-day activities. They also have to show that the employer was made aware of the disability and that the employer failed to make reasonable adjustments. How is a disability identified or assessed? A disability has to be a mental or physical disability that is substantial and it had long-term effect and impacts on your day-to-day activities. Now, this can be proved to your employer by the production of medical records, sometimes employers would want to do occupational health investigations. Those are the ways that you would seek to establish that you've got a disability. Thank you for watching I really hope you enjoyed this short video and if you did enjoy it please like and share. Winning Strategies for Anxiety Disorder Cases

09:08
If you are suffering with severe anxiety disorder, you know how difficult it can be to function normally in your day-to-day life. When you add the pressures of work - meeting deadlines, interacting with co-workers, supervisors, the general public, getting through 8 hours a day regularly - anxiety disorder can shut you down. Social Security disability focuses on the impact of your anxiety disorder on work functioning. In this video I speak about the two arguments I use to win when representing clients with anxiety issues, PTSD and associated mental health conditions. In many cases I use both arguments. The Listing argument arises from Listing 12.06 and, in my experience, generally requires that we have evidence of in-patient psychiatric hospitalizations, suicide attempts, and long standing, but unsuccessful treatment. In addition to the Listing argument, I also will set forth a functional capacity theory of disability, using non-medical evidence such as statements from former co-workers or supervisors to document that my client would not be reliable at any type of job. Both the Listing argument and the Functional Capacity argument require that we show that you would not be able to fulfil the requirements of a simple, entry-level job, 8 hours a day, 5 days a week. =============== FREE SURVIVAL KIT ================ Don't know where to begin? Anatomy of an Epidemic - The Explosion of Mental Illness in the West

01:01:13
Buy Book: http://www.fdrurl.com/whitaker Robert Whitaker discusses his book 'Anatomy of an Epidemic: Magic Bullets, Psychiatric Drugs, and the Astonishing Rise of Mental Illness in America' In this astonishing and startling book, award-winning science and history writer Robert Whitaker investigates a medical mystery: Why has the number of disabled mentally ill in the United States tripled over the past two decades? Every day, 1,100 adults and children are added to the government disability rolls because they have become newly disabled by mental illness, with this epidemic spreading most rapidly among our nation's children. What is going on? Anatomy of an Epidemic challenges readers to think through that question themselves. First, Whitaker investigates what is known today about the biological causes of mental disorders. Do psychiatric medications fix "chemical imbalances" in the brain, or do they, in fact, create them? Researchers spent decades studying that question, and by the late 1980s, they had their answer. Readers will be startled—and dismayed—to discover what was reported in the scientific journals. Then comes the scientific query at the heart of this book: During the past fifty years, when investigators looked at how psychiatric drugs affected long-term outcomes, what did they find? Did they discover that the drugs help people stay well? Function better? Enjoy good physical health? Or did they find that these medications, for some paradoxical reason, increase the likelihood that people will become chronically ill, less able to function well, more prone to physical illness? This is the first book to look at the merits of psychiatric medications through the prism of long-term results. Are long-term recovery rates higher for medicated or unmedicated schizophrenia patients? Does taking an antidepressant decrease or increase the risk that a depressed person will become disabled by the disorder? Do bipolar patients fare better today than they did forty years ago, or much worse? When the National Institute of Mental Health (NIMH) studied the long-term outcomes of children with ADHD, did they determine that stimulants provide any benefit? By the end of this review of the outcomes literature, readers are certain to have a haunting question of their own: Why have the results from these long-term studies—all of which point to the same startling conclusion—been kept from the public? In this compelling history, Whitaker also tells the personal stories of children and adults swept up in this epidemic. Finally, he reports on innovative programs of psychiatric care in Europe and the United States that are producing good long-term outcomes. Our nation has been hit by an epidemic of disabling mental illness, and yet, as Anatomy of an Epidemic reveals, the medical blueprints for curbing that epidemic have already been drawn up.

A Mental Health Limitation disability benefit denial by Principal Financial after 24 months

We are available nationwide: call 855-319-4421 or email: https://www.diattorney.com/free-consultation/?referrer=yt Disability insurance attorney Stephen Jessup discusses a pending case that is in the Administrative Appeal process. The client's claim was initially approved by Principal under the 2-year Mental Health Limitation Policy Provision. During this 2-year period, the client suffered a head injury which required being hospitalized for several days. The client was diagnosed with post-concussion syndrome and, as a result, suffered from cognitive difficulties which are disabling. The client underwent Neuropsychological testing, however Principal concluded that the cognitive difficulties were related to the mental health condition, not the head injury. Some disability insurance policies, including the Principal policy at issue in this case, specify that if a disorder is contributed to, or caused by a mental health condition, benefits will be limited to a period of 2 years under the Mental Health Limitation Policy Provision. Attorneys Dell & Schaefer now have the task of proving that the client's cognitive difficulties are due to organic brain disease and not a mental health condition. If you suffer from a cognitive disorder or if your claim has been denied due to the 2-year Mental Health Limitation, please feel free to contact any of our disability attorneys for a free consultation to discuss your disability insurance claim. ---------------------------------------------------------------------------- 6 WAYS WE CAN HELP YOU 1 - Applying For Disability Benefits: https://www.diattorney.com/disability-application/?referrer=yt 2 - Appeal Of A Disability Denial (ERISA): https://www.diattorney.com/group-erisa-claim-denial/?referrer=yt 3 - ERISA Disability Lawsuits: https://www.diattorney.com/erisa-lawsuits-trials/?referrer=yt 4 - Non-ERISA Disability Benefit Denials: https://www.diattorney.com/disability-claim-denial-benefits-denied/?referrer=yt 5 - Monthly Disability Claim Handling: https://www.diattorney.com/monthly-claim-handling/?referrer=yt 6 - Lump-Sum Disability Policy Buyouts: https://www.diattorney.com/lump-sum-policy-buyouts/?referrer=yt ---------------------------------------------------------------------------- Our nationwide disability insurance attorneys have represented thousands of disabled claimants with their claims for either short term disability, long term disability, or long-term care benefits against every major disability insurance company. Disability Benefits for Survivors of Childhood Sexual Abuse

08:35
A significant number of my clients alleging disability based on depression, bi-polar disorder, PTSD and other mental health conditions have been victims of childhood sexual abuse or trauma. As I discuss in this video, the impact of long ago sexual abuse can be revealed many years after the fact and in many ways, and even if the abused person has received or is receiving counseling or psychiatric treatment, that person may still qualify for disability. Social Security defines disability in terms of how this type of trauma has impacted and would likely impact a claimant’s ability to perform the duties of a job. In the case of a sexual abuse survivor, intrusive memories, problems with attention, concentration, ability to focus and problems with interpersonal relationships often create work limitations. Long term mental health treatment records and firm support from a treating psychologist or psychiatrist can document to a Social Security judge that a claimant would not be a reliable employee at even a simple, entry-level job. ===============FREE SURVIVAL KIT==================== Don’t know where to begin? We are available nationwide: call 855-319-4421 or email: https://www.diattorney.com/free-consultation/?referrer=yt Disability insurance attorneys Gregory Dell and Stephen Jessup discuss long term disability claims due to cancer. Disability insurance companies will not dispute a diagnosis of cancer. The problems occur once a person is cured of the cancer, or it has gone into remission, but the person still suffers from symptoms. Often, the treatment that cured the cancer will cause after-effects such as cognitive issues or severe fatigue. Because the disability is caused by these residual symptoms and not by the actual cancer disease itself, the claimant may struggle to prove to the disability insurance company that they are in fact disabled as a result of the cancer. Often, the disability insurance company will attempt to attribute the claimant's symptoms to a mental/nervous condition, such as depression or anxiety, which limits the claimant to only receiving 24 months of benefits. Once the cancer is no longer an active health threat, a claimant often will stop treating with their oncologist or specialist, and instead follow with their primary care physician. It is essential for the treating physician to properly document your symptoms, how the symptoms affect your functional capacity to perform your job, and then relate the symptoms to the cancer treatment or whatever the underlying cause may be. ---------------------------------------------------------------------------- 6 WAYS WE CAN HELP YOU 1 - Applying For Disability Benefits: https://www.diattorney.com/disability-application/?referrer=yt 2 - Appeal Of A Disability Denial (ERISA): https://www.diattorney.com/group-erisa-claim-denial/?referrer=yt 3 - ERISA Disability Lawsuits: https://www.diattorney.com/erisa-lawsuits-trials/?referrer=yt 4 - Non-ERISA Disability Benefit Denials: https://www.diattorney.com/disability-claim-denial-benefits-denied/?referrer=yt 5 - Monthly Disability Claim Handling: https://www.diattorney.com/monthly-claim-handling/?referrer=yt 6 - Lump-Sum Disability Policy Buyouts: https://www.diattorney.com/lump-sum-policy-buyouts/?referrer=yt ---------------------------------------------------------------------------- Our nationwide disability insurance attorneys have represented thousands of disabled claimants with their claims for either short term disability, long term disability, or long-term care benefits against every major disability insurance company. The surprisingly dramatic role of nutrition in mental health | Julia Rucklidge | TEDxChristchurch

17:43
NOTE FROM TED: Please consult with a mental health professional and do not look to this talk for medical advice as the intersection of mental health and nutrition is still an emerging field of study. We've flagged this talk for falling outside TEDx's curatorial guidelines because it oversimplifies interpretations of legitimate studies. TEDx events are independently organized by volunteers. The guidelines we give TEDx organizers are described in more detail here: http://storage.ted.com/tedx/manuals/tedx_content_guidelines.pdf This talk was given at a local TEDx event, produced independently of the TED Conferences. In this critically important talk, clinical psychologist Julia Rucklidge explores a range of scientific research, including her own, showing the significant role played by nutrition in mental health or illness. Julia J Rucklidge, PhD is a Professor of Clinical Psychology in the Department of Psychology at the University of Canterbury, Christchurch, New Zealand. Originally from Toronto, she did her training in neurobiology (McGill) and Clinical Psychology (University of Calgary). Her interests in nutrition and mental illness grew out of her own research showing poor outcomes for children with significant psychiatric illness despite receiving conventional treatments for their conditions. For the last 6 years, she has been investigating the role of micronutrients in the expression of mental illness, specifically ADHD, Bipolar Disorder, anxiety and more recently, stress and PTSD associated with the Canterbury earthquakes. About TEDx, x = independently organized event In the spirit of ideas worth spreading, TEDx is a program of local, self-organized events that bring people together to share a TED-like experience. At a TEDx event, TEDTalks video and live speakers combine to spark deep discussion and connection in a small group. These local, self-organized events are branded TEDx, where x = independently organized TED event. The TED Conference provides general guidance for the TEDx program, but individual TEDx events are self-organized.* (*Subject to certain rules and regulations)

Anxiety Disorder and Social Security Disability: Winning Strategies for Your Claim

Severe, unrelenting anxiety disorder can make it all but impossible to hold a job. Stress caused by a reprimand from your boss, chatter from co-workers, or complaints from an unhappy customer can overwhelm you to the point where you lose the capacity to get through a workday. If you are extremely sensitive to stress to the level where your anxiety level leaves you non-functional, you may have a viable and legitimate claim for Social Security disability benefits. As I discuss in this video, anxiety cases in Social Security disability claims can be difficult because there are no objective tests like an MRI or CT scan that allows your doctor to “see” your anxiety. But long term treatment records and support from your doctor in the form of a functional capacity evaluation or a statement that you meet Listing 12.06 can be enough to convince a judge to award benefits. Many of my clients who struggle with anxiety also struggle with idea of starting the process and applying for disability. Often, knowing how the process works can reduce your stress level. =============== FREE SURVIVAL KIT ================ Don't know where to begin? Lyme Disease Long Term Disability Insurance Claim Tips

05:53
We are available nationwide: call 855-319-4421 or email: https://www.diattorney.com/free-consultation/?referrer=yt Disability insurance attorneys Gregory Dell and Rachel Alters discuss Lyme Disease and disability claims relating to this disease. Lyme disease is a very controversial diagnosis for disability insurance companies. Lyme disease is contracted through a tick bite and affects about 30,000 people a year across the United States. Typically, persons diagnosed with Lyme disease will be initially treated with 2-4 weeks of antibiotics. After that time, doctors consider the person to be free from the disease. However, a person may experience long-term symptoms of Lyme disease even after being treated with the course of antibiotics. Those symptoms may be flu-like symptoms, dizziness, fatigue, widespread pain, or they may develop into issues with cognitive function or even heart issues. The biggest challenge a claimant will face is proving that the continued symptoms which are preventing the claimant from performing his or her job are caused by Lyme disease, and not some other condition, such as Fibromyalgia, Chronic Fatigue Syndrome, or a mental disorder such as depression. Lyme disease is detected through diagnostic blood testing. However, laboratories may not always perform complete tests, which creates difficulties for the claimant as the disability insurance company will jump on any opportunity to discredit this diagnosis. The disability insurance companies often try to attribute the symptoms to other conditions like Fibromyalgia, Chronic Fatigue Syndrome, or depression, so that they can apply Self-Reported Symptom or Mental/Nervous Limitations, which limit the length of time a claimant may receive disability benefits. ---------------------------------------------------------------------------- 6 WAYS WE CAN HELP YOU 1 - Applying For Disability Benefits: https://www.diattorney.com/disability-application/?referrer=yt 2 - Appeal Of A Disability Denial (ERISA): https://www.diattorney.com/group-erisa-claim-denial/?referrer=yt 3 - ERISA Disability Lawsuits: https://www.diattorney.com/erisa-lawsuits-trials/?referrer=yt 4 - Non-ERISA Disability Benefit Denials: https://www.diattorney.com/disability-claim-denial-benefits-denied/?referrer=yt 5 - Monthly Disability Claim Handling: https://www.diattorney.com/monthly-claim-handling/?referrer=yt 6 - Lump-Sum Disability Policy Buyouts: https://www.diattorney.com/lump-sum-policy-buyouts/?referrer=yt ---------------------------------------------------------------------------- Our nationwide disability insurance attorneys have represented thousands of disabled claimants with their claims for either short term disability, long term disability, or long-term care benefits against every major disability insurance company. Does Fibromyalgia Qualify you for Disability Benefits?

05:32
In this video Marc Whitehead, Board Certified Disability Attorney, explains whether or not Fibromyalgia qualifies you for disability benefits. Fibromyalgia is a chronic disorder that effects about 5 million Americans. Patients suffer intense pain and aching in the muscles and soft tissues throughout the body including specific tender points. Symptoms also include: Fatigue Cognitive Dysfunction Irritable Bowel Syndrome Depression Anxiety The exact cause of Fibromyalgia is unknown and may involve different factors that, when working together, can effect the way the brain processes pain. Events or conditions that are likely to trigger Fibromyalgia are genetics, emotional and physical trauma, and certain illnesses or infections. While Fibromyalgia does not damage the joint or organs the constant pain and fatigue can inflict a devastating impact on your life. Although the pain associated with Fibromyalgia disability is real, there is no lad test or x-ray to measure the findings of Fibromyalgia. Doctors diagnose Fibromyalgia based on the patients symptoms and physical exams. For this and other reasons getting approval for disability benefits from the Social Security Administration, the Department of Veterans Affairs, or your Long Term Disability Insurance plan could be problematic. Social Security Disability Claims Based on Fibromyalgia: If Fibromyalgia prevents you from working, you may be entitled to Social Security Benefits. However winning disability under the SSA disability program can be difficult. The SSA blue book which is the SSA reference manual containing the approval of medical listings of specific impairments does not even include Fibromyalgia. Since there is no medical listing, the Social Security Examiner will attempt to equate your disability with an existing medical listing. They will also consider and give value to accompanying impairments that may be involved, such as: Osteoarthritis Degenerative Disk Disease Lupus However the determining factor for qualifying for Social Security Disability benefits is whether Fibromyalgia or any other impairment effects your ability to work. Long Term Disability Insurance Claims Based on Fibromyalgia: LTD Insurance Benefits for disability based on Fibromyalgia are available under most policies. However many insurance companies are unsympathetic towards policy holders who submit claims based on Fibromyalgia. Insurers tend to view these claims with skepticism. Common reasons for claim denials include characterizing that Fibromyalgia is treatable or, without specific diagnostics to show cause, there is no reason to consider you disabled from sedentary work. Insurance providers often lead you to believe that your case is defeated and you'll have no alternative. They will apply misleading tactics using their own medical records or vocational evaluations to dispute your claim. They may delay the process by not responding or making continual additional demands for information. Also, they may even hold out until forced by the court to give you the benefits that you are entitled to. Veterans Disability Claims Based on Fibromyalgia: Veterans can claim disability based on Fibromyalgia if they can prove it was connected to their service in the military. The VA Schedule for rating disability lists that evaluation criteria for Fibromyalgia under the muscular skeletal system. Disability claim approval and rating levels vary according to several criteria. Such as whether the symptoms are wide spread, on both sides of the body and above the waist, constant or episodic or require continuous medication. Any disability including a mental disorder that is medically determined to be secondary to Fibromyalgia can be separately evaluated. With over 700,000 troops serving in the Persian gulf beginning in august of 1990, countless Veterans came home with symptoms of muscle, joint and bone pain, debilitating fatigue, memory and thinking disorders, emotional distress, and other symptoms indicating Fibromyalgia. As of 2009 the VA identified Fibromyalgia as a presumptive disorder for Gulf War Veterans who meet the criteria of the Va schedule for rating disabilities. These Veterans do not need to prove a connection to their military service and Fibromyalgia in order to receive their benefits. Although Fibromyalgia is considered a presumptive illness securing disability compensation can be tremendously difficult. Many veterans who served in other locations are also disabled by Fibromyalgia.
