After denouncing Trump’s positions on repealing the Affordable Care Act, which could hurt veterans, as well as his ban on Muslim immigration, the ad closes by calling out Trump on one of his biggest fears. “You want to be a legitimate president, sir?” the narrator challenges. “Then act like one.” The concerns about repealing the Affordable Care Act include that it will toss veterans who aren’t eligible for medical care under the Department of Veterans Affairs off of any form of health insurance. Similarly, because the ACA required insurance companies to include mental health coverage in all of their plans, repealing the ACA risks making it so that veterans with mental health issues (a common problem within that community) won’t be able to receive the assistance they need.

It is the identification of a truth about how human beings can live optimally in a social context. Thus, it is the bridge between individual ethics and politics/political theory. The right identifies what you can do without anybody's permission and what you need permission for. The basic right is the right to life and all other rights stem from that right. The right to liberty and the right to property are required for optimal living and thus natural rights. This is the use of the word right such as in the Declaration of Independence, or in the Rights of Man, by John Locke and should be distinguished and differentiated from a strictly legal right, which is what the law defines as what you can do without anybody's permission. A legal right may be in conflict with natural rights. It is what the law says you can do without permission or another must do. My interview with Sen. Bernie Sanders is in the context of natural rights, the fundamental concept discussed above. When I ask him, is all legitimate governmental power derived from the people, he says, yes. Legitimate governmental power is power exercised by right and he accepts that human beings/citizens are the source of legitimate power, as is the constitutional phrase we the people, who have the rights delegate it to the government and therefore rightful action can only be rights that could have been properly delegated to the government. The natural right of self-defence of your life, liberty and property is what is delegated partially to the government, while reserving the right to protect yourself individually as well. Yet Bernie Sanders claims you can properly delegate a right you do not have. This is absurd, because you cannot give what you don't have. If he had not stopped answering questions this would have become evident like it was in my interview, Bill Richardson and others. Obviously, you can properly delegate your right to self defence: life , liberty and property and form a government dedicated to protecting our individual rights i.e. a limited government, but not redistribution of wealth like Bernie wants to do whole sale.

Another flaw often found item during the discovery process is the “funding” of assets into the wrong vehicle. Certain vehicles have great use for specific business functions supported by statute, tax law, and case history. You and your planner must have a good handle on these issues and know what pros and cons each entity presents, what the effect on your liquidity will be and what it will take to maintain and support that stated business purpose as a start (starting to see the detail required?). One good example is the common misuse of Family Limited Partnerships (FLP) to own the client’s personal residence. What is the legitimate business purpose of using a vehicle that is most often created for “family investment management and wealth transfer” to own the house you personally live in? If you’re not paying the FLP commercially reasonable rent, you probably don’t have one. In this case the plaintiffs will successfully argue that you are using the FLP as personal piggy bank that is not legally distinct from you and your personal assets and liabilities and the I.R.S. won’t find it cute either. Similarly, we often see dangerous articles of personal property like your personal vehicles moved into this structure or others like an LLC or S-Corp. that is your primary business; or equally dangerous, into an entity like an FLP that is holding safe and attractive assets like cash, stocks, bonds and other liquid assets. Think about it, if you lease or own your vehicle through your business, you have linked the most dangerous thing you likely do on a daily basis, i.e. drive a car, and linked it to either the source of your wealth, your business or in the case of your FLP, the place you keep your wealth. You are actually un-doing the protection and legal segregation of risks these structures may have provided. Many times the tax advantages override the liability because a deduction in the hand is real money. But owning assets in the wrong entity exposes assets unnecessarily. In this Majority Report clip, a disabled veteran hits Trump on the effects repealing Obamacare will have on vets and their families. "VoteVets.org, a group that focuses on “matters including, but not limited to, foreign policy, energy security, veterans’ unemployment, and opening military service to life-long Americans born to undocumented immigrants, as well as continued investment in care for veterans,” released an ad on MSNBC’s “Morning Joe” on Monday that calls out President Donald Trump by name. The 30-second spot shows a veteran lifting weights while the camera slowly pans back to reveal that he only has one leg. After denouncing Trump’s positions on repealing the Affordable Care Act, which could hurt veterans, as well as his ban on Muslim immigration, the ad closes by calling out Trump on one of his biggest fears. “You want to be a legitimate president, sir?” the narrator challenges. “Then act like one.” The concerns about repealing the Affordable Care Act include that it will toss veterans who aren’t eligible for medical care under the Department of Veterans Affairs off of any form of health insurance. Binge Eating Disorder History A Timeline. What Is Binge Eating Disorder?. Binge eating disorder (BED) is the most common eating disorder in the United States, and it’s diagnosed in all age groups. It’s most prevalent, though, among teens and adults. People with BED eat unusually large amounts of food in a short period of time and feel a loss of control and guilt over these bingeing episodes. Researchers estimate that up to 60 percent of people who struggle with BED are women. The cause for the disorder is unknown, but there are likely social, biological, and psychological factors. Without help, the long-term consequences of binge eating include: *weight gain. *high blood pressure. *heart disease. *diabetes. *other obesity-related diseases. 1959: First Mention of Binge Eating: BED was first noted back in 1959 by psychiatrist Albert Stunkard. In his paper titled “Eating Patterns and Obesity,” Stunkard describes an eating pattern marked by consuming large amounts of food at irregular intervals. He observed that some of these episodes were linked to night eating. The term binge eating eventually caught on. It was used to describe eating episodes that were not connected with sleep or the overnight hours. 1987: The APA’s DSM: The American Psychiatric Association (APA) mentioned binge eating in its Diagnostic and Statistical Manual of Mental Disorders (DSM) in 1987. At the time, the condition was listed in the criteria and features of bulimia. Bulimia is an eating disorder that takes on a cycle of bingeing and purging. Inclusion in the DSM is important because it increases disease awareness and gives mental disorders legitimacy. Prior to being included in the DSM, it was difficult for people to receive appropriate treatment for binge eating. Health insurance coverage for treatment of the disorder was also limited. 1994: Link to EDNOS: In 1994, the APA listed binge eating in the DSM-4. At this point, it was still not known as its own disorder, though. Instead, binge eating was included in an appendix as a feature of “eating disorder not otherwise specified,” or EDNOS. 2008: The BEDA Forms: BED continued to gain more attention. By 2008, a nonprofit called the Binge Eating Disorder Association (BEDA) was started. This group’s mission is all about help, support, and advocacy for the BED community. BEDA holds various events throughout the year and an annual conference. BEDA also hosts a Weight Stigma Awareness Week and supports BED research. 2013: Full Recognition in the DSM: In 2013, the APA released a revised edition of the DSM. This time, the DSM-5 declared BED as its own disorder. This is significant because it finally allowed people to get treatment under their insurance plans. It also added legitimacy to the disorder. The new classification included the following criteria: *recurrent episodes of binge eating. *association with eating alone, consuming foods rapidly, or feeling guilt and shame. *feelings of distress related to eating behaviors. *frequency of bingeing at least once a week for three or more months. *absence of restricting or purging behaviors (common with anorexia or bulimia). January 2015: Drug Therapy Introduced: In January 2015, the Food and Drug Administration approved the use of lisdexamfetamine dimesylate (Vyvanse) for the treatment of BED. The efficacy and safety of this drug were examined in a study published in the Journal of the American Medical Association. Researchers found that those given 50 to 70 milligrams of lisdexamfetamine dimesylate reported less or even total cessation of bingeing. They also reported only a few side effects. Where We Are Today: With BED now recognized as an eating disorder, more research is being done on both therapy and drug-based treatment options. One of the most effective therapies for eating disorders is cognitive behavior therapy. This method continues to be the most popular approach for both in- and outpatient treatment. One-time rollovers from IRAs to HSA accounts: This provision allows for a once-in-a-lifetime distribution of amounts from an IRA (either a Traditional IRA or a Roth IRA), in a direct trustee-to- trustee transfer. Unless the only money available is in your Roth IRA, you shouldn’t use it. The best use of the exchange is with an IRA. Amounts distributed under this provision are not includible in income to the extent that they would otherwise be includible in income, and they are not subject to the 10% penalty tax on early distributions. The maximum amount that may be distributed from the IRA and contributed to the HSA is limited to the otherwise maximum deductible contribution amount to the HSA. No deduction is allowed for the amount contributed from an IRA to an HSA. Keep in mind that there is a testing period for contributions in a 12-month period. The HSA accounts are one of the best provisions in the tax code that actually generates significant value to the consumer. Florida Is Illegally Blocking Poor People From The E.R.

In 2012, the Scott administration lobbied the federal Centers for Medicare and Medicaid Services (CMS) to allow it to limit the number of times that Medicaid beneficiaries can frequent emergency rooms to six visits. The Obama administration rejected that request, arguing that it constitutes a violation of the Social Security Act by placing "an arbitrary limit" on a legally mandated benefit, and that it has the potential to harm poor patients, the Miami Herald reports. But the Scott administration ignored CMS's decision and instituted the ER cap after filing an appeal. Now, CMS has responded by warning that it will withhold federal matching funds for Florida's Medicaid program if the state doesn't change its tactics. "We hope the state will realign their Medicaid program with federal standards to avoid this penalty," said Emma Sandoe, a CMS spokesperson, in a statement. The fine is expected to be a 10 percent reduction in matching funds in the first year, with an additional five percent cut in subsequent quarters. The Scott administration argues that limiting emergency room visits is a way to encourage patients to stay out of the costly emergency care departments, and encourage them to use more cost-effective preventative and primary care doctor visits instead. Health care experts agree that primary care is preferable to using the emergency room — but people who enroll in Medicaid for the first time may not understand that from the get-go. Uninsured people typically rely on emergency departments and aren't used to navigating doctor's offices. Consequently, Medicaid beneficiaries may take some time to get acquainted with the nuances of the health care system. It's also unclear how effective such a cap would be at controlling costs, considering that just one percent of enrollees even use emergency departments six or more times in a year. As such, the cap may end up harming patients who legitimately have to use the ER a disproportionate number of times. Only a sliver of the poorest Florida residents — parents with dependent children who make just a third of the Federal Poverty Level (FPL) — are eligible for Medicaid in the first place. So, when I talk about biotechnology, or biology, or healthcare in general, I think we're seeing a merging of data and health. (17:42) The other thing that I think Libby also was touching on is more and more of this is going to come from the consumer today. I mean, we’ve already seen this in general IT trends that consumer space is, in some respects now, influencing what happens in technology enterprises. We shouldn’t be surprised if the same things start happening in the bio space and the healthcare space that consumer trends will start influencing the insurance and the enterprise influences as well. And, what do I mean by that? Well, there are companies already that are using machine learning to identify one, who could be in a clinical trial automatically. I mean, trying to do this manually can take between three to six to nine months, if you do it manually. A machine can actually look at, if you choose to share data and say, “You would be perfect for this therapeutic drug treatment, would you like to do it or not?” And, that’s being done in near-real time as opposed to delays of six to nine months.

Texas Long Term Disability Lawyer on Understanding Your Denial Letter
Texas long term disability lawyer Marc Whitehead, Board Certified Long Term Disability Attorney, discusses how to understand your denial letter. http://www.disabilitydenials.com/ Long Term Disability Insurance companies are notorious for denying legitimate claims based on obscured disability definitions contained in the policy. There is no one legal definition of disability. Every insurance company, the Social Security Administration, and the Veterans Administration all have different definitions. After a Long Term Disability Insurance Claim is filed the insurance carrier will either grant the claim or deny claim. If the claim is granted the insurance company will begin to pay monthly benefits. If the claim is denied the claimant will receive a denial letter. This letter is very important because it will list the evidence the insurance company reviewed when making it's decision. Who reviewed the evidence- for example an in house nurse, case manager or even a doctor hired as a consultant or non- medical reviewers. Most major insurance carriers such as UNUM, Cigna, MetLife, and Aetna follow this procedure. The denial letter should state the reasons this claim was denied and what medical evidence the carrier needs to prove disability. The denial letter will also give important information for an appeal including, when and where an appeal must be received, the time limits for filing an appeal, and how the administrative appeal should be structured. What are the time limits for filing your administrative appeal? The denial letter will give you the time limits for filing the appeal. If the policy is governed by ERISA or the Employee Retirement Income Security Appeals Act, the appeals deadline is 180 days. Most non-ERISA policies also give the claimant 180 days to appeal but it is very important to read the denial letter carefully so no deadlines are missed. If an appeals deadline is missed the claimant will be unable to appeal further or file a lawsuit in Federal court to enforce their rights. If the claimant doesn't exhaust or use all of the appeal available the claimant will not be allowed to file a lawsuit. As I just stated, Long Term Disability Insurance claims are usually governed under Federal ERISA regulations. If a claimant goes through the Administrative appeals process and is denied their disability benefits their only remedy is to file a civil lawsuit to enforce their rights under the policy. This leads to several important questions. The first questions is- Who can sue? Any plan beneficiary or participant may bring suit to enforce their rights under the plan or policy. This generally means the disabled individual, but in some cases it could mean their spouse or an estate. Typically in disability claims the suit will be brought against the plan or the plans fiduciary. The second question- Who do you sue? Typically in a disability plan the suit will be brought against the plan or the plan fiduciaries, often called the plan administrator. Frequently the plan administrator is the under writing insurance company. That's the reason we generally refer to the insurance company throughout our eBook when we are speaking about the plan. Occasionally, but not often, the proper defendant is the claimants employer. The test is who had authority under the plan to grant or deny a disability claim. Most major insurance carriers such as UNUM, Metlife, Cigna and Aetna follow this structure. ERISA based Federal Lawsuits are complicated and can't be filed in your local county of in small claims court. Always consult with an experienced ERISA attorney before pursuing any legal action.
