Gobeille v. Liberty Mutual Insurance Co.: Oral Argument - December 02, 2015
Facts: Liberty Mutual Insurance Company (Liberty Mutual) operates a self-insured employee health plan through a third-party administrator. Vermont state law requires that all health plans, including self-insured plans, file reports containing claims data and other information with the state. The statute specifies what type of information is required and how it is transmitted. When Vermont subpoenaed claims data from the third-party administrator, Liberty Mutual sued the state and argued that the reporting requirements of the Employment Retirement Income Security Act of 1974 (ERISA) preempted the Vermont statute. The district court found in favor of the state and held that ERISA did not preempt the Vermont statute. The U.S. Court of Appeals for the Second Circuit reversed and held that ERISA preempted the state statute because the state statute’s requirements were connected to the ERISA requirements and therefore were preempted. Question: Do the reporting requirements of the Employee Retirement Income Security Act of 1974 preempt a Vermont state statute regarding reporting requirements as applied to a self-insured employee health plan? Conclusion: The reporting requirements of the Employee Retirement Income Security Act of 1974 (ERISA) preempt a Vermont state statute regarding reporting requirements as applied to a self-insured employee health plan. Justice Anthony M. Kennedy delivered the opinion for the 6-2 majority. The Court held that the preemption clause of ERISA was meant to be construed broadly, and precedent has established that ERISA preempts a state law when the existence of ERISA plans is essential to the operation of the state law or when the state law interferes with nationally uniform plan administration. Because ERISA contains various recordkeeping, disclosing, and reporting requirements that are integral aspects of ERISA, the Vermont state statute interferes with nationally uniform plan administration. In his concurring opinion, Justice Clarence Thomas wrote that, while the majority’s opinion follows precedent regarding ERISA preemption, that preemption jurisprudence is possibly becoming impermissibly broad. In future cases, the Court may have to address the question of whether the Constitution allows such broad federal preemption of state laws. Justice Stephen G. Breyer wrote a separate concurring opinion in which he emphasized that ERISA preemption avoids the potential of having different reporting requirements in each state. However, if a state needs information beyond what ERISA requires, it can request authorization through the Secretary of Labor. Justice Ruth Bader Ginsburg wrote a dissent in which she argued that Vermont’s statute serves a different purpose than the ERISA reporting requirements and therefore should not be preempted. While ERISA’s reporting requirements allow the Secretary of Labor to examine plan management and solvency, the Vermont statute is concerned with how residents obtain health care and how effective it is. Because the state statute does not impose burdens on plan management that effectively dictate the plans’ administration, preemption is not required. Justice Sonia Sotomayor joined in the dissent. In this, the final Maps of Meaning lecture for 2017, I review the year and its offerings: What is a belief system? Why are people so inclined to engage in conflict to protect their belief systems? It's partly because our belief systems are not only systems of belief, but structures that serve to render everyone who participates in that belief and its dramatization and acting out in the world predictable, trustworthy and cooperative (even when competing). Is there a hierarchy of rank or value among belief systems, or are they merely arbitrary? What is the relationship between descriptions of the objective world and moral guidelines? How do you determine how to conduct yourself in the world? What should you do (and is that question even genuine -- or answerable?) What inbuilt structures do you bring into the world, as a consequence of biological evolution, that help you orient yourself in life, in the face of its overwhelming complexity? What is the relationship between the games that children learn to play when becoming socialized and the cultural structures that guide us in broader society? How is all this related to the underlying symbolic structures (religious structures) that sit at the base of our societies and belief structures? Born in Massachusetts in 1840, he served in the U. S. Volunteers during the Civil War from August, 1862, until October, 1865. In his varied career he taught school; worked upon newspapers; lectured in various fields for 17 years, and was 7 years a Unitarian minister. He entered the work of mental healing and teaching in 1893. He thus gained by experience that which he taught in his books. Brown was responsible for the publication of one of the most vigorous of the New Thought periodicals, Now, published in San Francisco, Cal., described in its subtitle as "a Monthly Journal of Positive Affirmations, devoted to Mental Science and the Art of Living." This magazine was established by Henry Harrison Brown, in 1900. Its basic affirmation was, "Man is spirit here and now, with all the possibilities of Divinity within him and he can consciously manifest these possibilities here and now." Lawmakers respond to constituents, seek higher office, have lofty goals, and even learn from their mistakes. But do they actually make the world a better place? In this lecture, the first of this year’s Chicago’s Best Ideas series, Professor Levmore examines some aspects of lawmaking that do not make their way into the law school curriculum. First, lawmakers may be forward-looking, but they have tools that are backward looking, or retroactive, and this combination can help us understand why some lawmaking is quite durable, while some of it falls apart both physically (like crumbling bridges) and conceptually (like conventional views about sex and marriage). Second, lawmakers might be rewarded when they innovate successfully, but they are penalized harshly for making changes that backfire. This trade-off helps us understand where we do or do not observe experiments and progress, ranging from Uber to health-care. Saul Levmore is the William B. As a point of entry and exit, a threshold has a dual coding in society as both a physical and symbolic marker of separation and connection. Thresholds are often explicitly hard-edged or even brutal in their expression, demarcating rigid boundaries, as in the definitive lines of walls, barricades, and security checkpoints in buildings, around cities, or across larger territories. Too often, thresholds also divide human activity or communities according to social, ethnic, national, or economic characteristics. Architecture and planning can unwittingly contribute to these different forms of physical separation, especially in ways made visible through their practitioners’ interpretations of culture, religion, or legislation. As the academic disciplines that inform spatial practices, architecture and planning are themselves often similarly separated by disciplinary thresholds, inhibiting porosity between fields of research. By definition, an individual discipline necessarily is organized around a self-referential center of discursive production, but this often happens at the expense of the richness found at the intersection of multiple disciplinary perspectives. Is architecture, in its compulsive drive to create the autonomous object, inherently hardening the thresholds separating it from other disciplines and, by extension, reproducing those schisms within the built environment? Can architecture and planning intentionally construct soft thresholds – lines that are easily traversed, even temporarily erased – thereby allowing for multiple perspectives across different modes of research and practice and catalyzing disciplinary and social connections? What, then, is the physical expression of a soft threshold – a space that is visually and physically porous, plural in spirit, encompassing of its context, and yet rigorous in its expression? In this talk, Mehortra discusses these and other considerations with reference to the current GSD exhibition of the same title, on the works of RMA Architects, Mumbai + Boston, representing the compulsive drive of the practice to construct soft thresholds – through research, engagement with the city, and making of architecture.

Lum and Abner was an American network radio comedy program created by Chester Lauck and Norris Goff that was aired from 1931 to 1954. Modeled on life in the small town of Waters, Arkansas, near where Lauck and Goff grew up, the show proved immensely popular. In 1936, Waters changed its name to Pine Ridge after the show's fictional town. The series was created by co-stars Chester Lauck (who played Columbus "Lum" Edwards) and Norris Goff (Abner Peabody). The two characters performed as a double act, with Lum generally playing the straight man to Abner's attempts to break free from Lum's influence. As co-owners of the Jot 'em Down Store in the fictional town of Pine Ridge, Arkansas, the pair are constantly stumbling upon moneymaking ideas only to find themselves fleeced by nemesis Squire Skimp, before finally finding a way to redeem themselves. Lum and Abner played the hillbilly theme with deceptive cleverness. The hillbillies knew that the slickers would get what was coming to them sooner or later and either didn't mind or knew more than they let on that the slickers getting theirs was a matter of fortunate circumstance. In addition to the title characters, Lauck also played Grandpappy Spears and Cedric Weehunt while Goff played Abner, Squire Skimp, Llewelyn "Mousey" Grey, Dick Huddleston, and most of the other characters. Lauck and Goff had known each other since childhood and attended the University of Arkansas together where they both joined the Sigma Chi Fraternity. They performed locally and established a blackface act which led to an audition at radio station KTHS in Hot Springs, Arkansas. Prior to the audition, the two men decided to change their act and portray two hillbillies, due to the large number of blackface acts already in existence. After only a few shows in Hot Springs, they were picked up nationally by NBC, and Lum and Abner, sponsored by Quaker Oats, ran until 1932. Lauck and Goff performed several different characters, modeling many of them on the real-life residents of Waters, Arkansas. When the Quaker contract expired, Lauck and Goff continued to broadcast on two Texas stations, WBAP (Fort Worth) and WFAA (Dallas). In 1933, The Ford Dealers of America became their sponsor for approximately a year. Horlick's Malted Milk, the 1934–37 sponsor, offered a number of promotional items, including almanacs and fictional Pine Ridge newspapers. During this period, the show was broadcast on Chicago's WGN (AM), one of the founding members of the Mutual Broadcasting System. Effective July 1, 1935, the program was also carried on WLW (Cincinnati, Ohio), KNX (Los Angeles, California), and KFRC (San Francisco, California). Along with The Lone Ranger, Lum and Abner was one of Mutual's most popular programs. In 1936, Dick Huddleston of Waters petitioned the United States Post Office to change the town's name to Pine Ridge.[4] Postum cereal sponsored Lum and Abner in 1938–40, before Alka-Seltzer picked up the duo. Miles Laboratories, manufacturers of Alka-Seltzer and One-A-Day Vitamins, became the longest-running sponsor, backing the program from 1941 until 1948. Over the course of its life, Lum and Abner appeared on the two other major radio networks in addition to NBC and Mutual: CBS and ABC (formerly NBC Blue). In 1948, the show changed from a 15-minute "comedic soap opera" to a 30-minute self-contained show. New writers were added, including Flying Tiger ace Robert T. Smith, along with an orchestra and a live audience. The new format was unpopular and the series came off the air in 1950. Lauck and Goff experimented with other formats during the hiatus, finally changing back to a 15-minute, Monday-Friday show on ABC in 1953,[5] but the revived show was discontinued the following year due to competition from television and Goff's failing health (Goff would eventually recover and continue making media appearances well into the 1960s).
